Our Commitment to Privacy

At Viocare, protecting your privacy is important to us. We understand you may have questions or concerns regarding the personal information you provide in connection with your use of this website and/or our various Programs and Services, and how it will be used. With this in mind, we have developed this Privacy and Content Use Policy. Please note that all capitalized terms not defined herein shall have the meaning ascribed to them in the User Agreement between you and Viocare.

Applicability of Privacy and Content Use Policy

This Policy applies to the Content, including User Data, you upload, post, email, transmit or otherwise make available via the Programs and Services, as well as any Content of Viocare, Users, and other third parties that you download, access, or otherwise receive via the Programs and Services.

Content We Collect and How It May Be Used

With some Programs and Services, you may be able to submit queries, download information, respond to questionnaires, or request services. The types of Content we collect when you access the Programs and Services may include, without limitation, the following:

Some of the Content we collect via the Programs and Services is gathered and maintained through the use of “cookies” and other methods. A “cookie” is a small file that is saved on your computer and that contains information about you, such as your user name and password. As a result, we are able to (a) recognize you when you access the Program or Service, so that you do not have to re-enter your personal or other information each time you visit the Program or Service, (b) customize and personalize the Content we make available to you, (c) maintain the “state” of your current visit, and (d) alert you to new features.

In addition, we may collect certain non-personal data in connection with the Programs and Services. For example, we may collect information on the browser that you use to access the Program or Service, the operating system that you are running, what items you clicked on the applicable web page, how long you viewed a certain page, and information about the web site you accessed immediately before you accessed the Program or Service. We may aggregate your non-personal data with the non-personal data of our other users or other non-personal data collected offline. We also collect and analyze general traffic patterns within our Programs or Services to help maintain the flow and Content, and we may use some or all of this information to support our commercial activities or for any other reason.

In addition, from time to time we may collect information relating to you, your child or a member of your household in connection with various studies or research that we or our customers may be conducting and that you voluntarily agree to participate in. In no event is your participation in these studies or research required, and in all cases you will be specifically advised that the requested information is being collected for purposes of the study or research. Where we have disclosed such studies or research to you, we may aggregate the personal information and other de-identified User Data you provide to us in connection with the Programs and Services with personal information and/or de-identified User Data provided by other users, and we may use such aggregated data in connection with such studies or research. In the event that at any time you wish to remove any personal information you provided in connection with one of our, or our customers’ research from our records, you may contact us as described below in “How to Contact Us.”

We may from time to time send information and/or offers to the email address you provide to us. If you prefer not to receive such email, you may follow any provided instructions in the email relating to how to have your email address “removed” from the applicable email list. Alternatively, you may contact us at any time ( see the “How to Contact Us” section provided below) to “opt-out” of receiving such emails.

Your Content (including User Data) is used by us and by others on our behalf to provide you with our Programs and Services. For instance, User Data may be used to create and manage an account in our records and to respond to your inquiries or requests. In addition, your provided debit/credit card and billing information is used to process your order(s) for our Programs and Services, and may be used in connection with our efforts to protect against and prevent fraud, unauthorized transactions, claims and liabilities, and to manage risk exposure. We may share certain personal information we collect with our affiliates, financial institutions that process debit and credit card transactions, and entities that assist with payment card fraud prevention. We also may share the information you provide through or in connection with your use of the Program and Services with our service providers who perform services on our behalf; however, we do not authorize these service providers to use or disclose the information except as necessary to perform the necessary services for us or to comply with legal requirements. We require these service providers by contract to appropriately safeguard the privacy and security of all of the personal information they receive and process in connection with the services they perform for us.

Except as specified in this Privacy Policy or as otherwise authorized by you, we will not disclose your personally identifiable information to any third party, unless required to do so by law; provided, however that we may (a) use such information to support our customer satisfaction initiatives, (b) from time to time disclose such information to selected third parties offering products or services in which you may be interested, and (c) disclose such information to other companies provided that such third party agrees to comply with the provisions of our Policy with respect to the use of your information and any User Data or Content. We also may disclose information about you when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. Moreover, we reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Privacy Policy. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information.

In addition, we may from time to time give you the ability to connect and communicate with other Users and other third parties through various sharing features in the Programs and Services, including chat conversations, blog messages, bulletin board postings, email communications, and similar transmissions. Any Content you provide through these means is shared on a voluntary basis, and is provided entirely at your own choice of whether to do so. As such, you need to ensure that you have the rights to share your Content with such parties, and wish to do so. Further, please understand that once you do, such parties may further use such Content, with or without your knowledge of such use. Accordingly, please do not provide any proprietary, personal or confidential information (including health information) about you or anyone else via such means. Should you do so, you will assume the sole risk and responsibility of such action or disclosure, and Viocare will have no responsibility to you, to any party about whom you have shared such information, or otherwise to any third party.

Content We Make Available and How It May Be Used

Viocare provides various Content through the Programs and Services for your personal use as an information resource. Such Content is protected by copyright and may not be copied or distributed to anyone else without Viocare’s prior written consent, except you are permitted to share such Content with your doctor, dietitian or other healthcare professional.

Viocare partners with organizations that wish to license Viocare Content for commercial use (i.e., display on their websites or other communications). For more information about Content licensing and partnership opportunities, please contact info@viocare.com.

In addition, you may use any Content you receive from other Users and third parties through various sharing features in the Programs and Services, provided that it is your responsibility to investigate, identify and differentiate Viocare Content from that of Users and third parties. Viocare disclaims any responsibility for any Content not provided by Viocare.

Our Commitment to Data Security

We strive to prevent unauthorized access to your provided personally identifiable information, to maintain data accuracy, and to ensure the correct use of such information. Accordingly, we have put in place physical, electronic, and managerial procedures to attempt to safeguard and secure the Content and User Data we collect. Specifically, we maintain appropriate administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We use SSL encryption on the Sites from which we transfer certain personal information.

However, no safeguards or security procedures are completely effective. We urge you to take all reasonable precautions to protect your User Data and any other personal information you wish to provide in connection with the Programs and Services, which should include (but is not limited to) never sharing your username and password with anyone.

Occasionally, in a scam known as "phishing," mass emailers will send messages that claim to be from Viocare, or one of our Programs or Services. They may use our name, logo, or employee email addresses in fraudulent emails trying to obtain valuable information from consumers and businesses. These con artists know that people trust Viocare. That is why they may use our name to trick you into believing that they are dealing with a legitimate request for personal information. These fraudulent emails often create a false sense of urgency intended to prompt the recipient to take action. We urge you to take all reasonable precautions to confirm that any emails your receive are legitimate, so as to protect your personal data. You can always direct inquiries about any emails you have received to us at info@viocare.com.

How to Access or Correct Your Content

You can access your personally identifiable information that we have collected and that we maintain by contacting us as described below in “How to Contact Us.” You can correct factual errors in your personally identifiable information by sending us a request that credibly shows that our records are incorrect, although we may refuse such requests in our sole discretion, and to protect your privacy and security, we may take steps to verify your identity before granting access to your personally identifiable information or permitting you to make corrections.

You may also withdraw any consent you previously provided to us, or object at any time on legitimate grounds, to the way we process your provided User Data. We will apply your preferences going forward. In some circumstances, withdrawing your consent to our use or disclosure of your provided User Data will mean that you cannot take advantage of certain Programs, Services or Benefits. In most cases, a refund of amounts previously paid will not be made available.

Changes to Our Policy

We reserve the right to revise this Privacy and Content Use Policy from time to time in our discretion. If we modify this Policy, we will post the revised Policy at https://www.vioscreen.com/VioSystem/PopupWindow.aspx?id=Privacy, which will take effect immediately upon posting, and we may attempt to notify you of such change through your email addresses registered with us. It is your responsibility to periodically review this Policy.
